The Supreme Court of the State of New York Appellate Division: Second Judicial Department recently released a decision to expedite the Town of Oyster Bay's appeal of Acting Supreme Court Justice Jeffrey Spinner's decision regarding the Mall at Oyster Bay on the Cerro Wire property in Syosset.

In the original decision, which was issued in June, the Town of Oyster Bay was ordered to issue a special use permit to the Taubman Company to build a 750,000 square foot mall on the 81-acre property. Also, the Taubman Company was ordered to submit a site plan for the 750,000 square foot mall as the previous plan that was submitted to the town was for an 860,000 square foot mall.

This recent decision puts strict guidelines in place for the case and states that the Town of Oyster Bay must file its appeal by August 27. The developer would then have to submit any subsequent appeal by September 26 and the town would then have to reply on or before Oct. 6.
